Legal aspects
The EU General Data Protection Regulation (GDPR) aims to harmonize data privacy laws across Europe, put into effect on May 25, 2018. The GDPR replaces the 1995 EU Data Protection Directive and requires organizations to utilize more stringent standards in order to be compliant with its regulations.
Intercom now offers Regional Data Hosting in the following regions: United States, Europe and Australia.
This enables new customers to control the location of their data storage. By creating a new Intercom Workspace in your desired region, your customer data will not leave that region.
If your organization is based in the US or Canada but has customers or employees who are located within the European Union (EU), then you will be obligated to meet these new requirements ie, migrating to a EU data hosted Workspace. If you don’t comply with GDPR rules, then you might face heavy penalties for non-compliance—as much as €20 million or 4% of annual global turnover!
If you are an SME that processes personal data, then you must comply with the GDPR. However, if processing personal data isn’t a core part of your business and your activity doesn’t create risks for individuals, then some obligations of the GDPR will not apply to you (for example the appointment of a Data Protection Officer (‘DPO’)). Note that ‘core activities’ should include activities where the processing of data forms an inextricable part of the controller’s or processor’s activities.
The GDPR regulation applies in this case
Your company is a small, tertiary education company based outside the EU targeting mainly Spanish and Portuguese language universities in the EU. The company provides free advice on a number of university courses, and students require a username and a password to access your online material. Students fill out an enrolment form to receive their username and password.
When GDPR doesn’t apply
Your company provides services to customers outside the EU. Its clients can use its services when they travel to other countries, including within the EU. If your company doesn’t specifically target its services at individuals in the EU, it is not subject to the rules of the GDPR.
